MINUTES of a meeting of the PLANNING COMMITTEE held on Monday 3rd February 2020 at 8.00 p.m. in the Parish Office, Arford Road, Headley

P84/19. APOLOGIES FOR ABSENCE
Apologies were received from Cllrs Chamberlain and Stubbings and it was RESOLVED to accept these apologies.
The minutes of the meeting held on 6th January 2020 were CONFIRMED as a correct record and SIGNED.
P86/19. DECLARATION OF INTERESTS
Members were reminded again of their responsibilities to declare any disclosable pecuniary interest that they may have in any item of business on the agenda and would be required to leave the room if they did.
Cllr Williams declared that as he is a member of EHDC Planning Committee and may be involved in the consideration of a planning application should it come before the District Council, he could participate in the discussion of all items on the agenda but would not vote and reserved his position until such time that he heard the full debate at the District Council.
No other declarations were made.
P87/19. CHAIRMAN’S ANNOUNCEMENTS
Cllr Luff suggested, and the Committee agreed, that now approval had been given to the development on the Whiteley’s site, it should be requested of the developers that the name given to the development be associated in some way with the words Robin Hood.

P89/19. PLANNING APPLICATIONS
It was RESOLVED that the following comments on the planning applications received from the Head of Planning and Development Services, EHDC, be passed to EHDC:
a) 58285 – Mr D Ruthven – Increase in roof height to provide accommodation at first floor level, Stagsdene, 110 Seymour Road, Headley Down – We OBJECT to this application for the following reasons:
Headley Down is made up of a variety of property sizes and styles, although those in the vicinity of 110 Seymour Road are mainly bungalow or chalet bungalow types of brick and tiles. The proposed two storey dwelling would be overbearing and dominating to its neighbours, close to the boundaries of 108 and 112. It would create overlooking and loss of privacy and also impact the property Flint Stones in West View Road.
i) EHDC Local Plan Joint Core Strategy Policy CP29 (d) states:
‘New development should ensure layout and design is sympathetic to its setting in terms of its scale, height, massing and density and its relationship to existing buildings.’
ii) EHDC Policy H1O (a) states that planning permission in Headley Down will be granted provided that:
‘There is no harm to the character and appearance of the area.’
iii) Policy CP27 of EHDC Local Plan Joint Core Strategy states:
‘Development will not be permitted if it would have an unacceptable effect on the amenities of the occupiers of neighbouring properties through loss of privacy and over-shadowing.’ The loss of privacy particularly affects number 108 because of the velux windows and the relationship between the two dwellings, Flint Stones because the first floor windows overlook the property and its garden (because 110 is at a higher level), and number 112 will suffer from loss of light and overshadowing because of the proximity of the proposed first floor extension.
iv) The Tree Preservation Order on the pine tree within the curtilage of the property was not noted on the application form.
v) The ground levels around the existing bungalow are not shown on the elevation drawings.
In summary, not enough information has been shown to demonstrate that the applicant has used any mitigating factors to overcome such objectional features as over-shadowing, over-looking, the bulk and height of the proposed new building works. These are reservations that the case officer also expressed in her pre-application letter.
Therefore, in view of the above policy reasons and explanations we object to this application.
b) 39625/001 – Mr & Mrs Horswill – Lawful development certificate for a proposed development – single storey rear extension following demolition of existing conservatory, 23 Church Fields, Headley – NO OBJECTION
c) 24355/005 – Breck Development Ltd – Replacement dwelling and associated garage, access and landscaping following demolition of The Studio, The Studio, High Breck, Spats Lane, Headley – NO OBJECTION subject to Policy H16.
d) 27722/005 – Mr & Mrs Fairclough– Replacement dwelling following demolition of existing, Heather Cottage, Arford Common – Although the design and appearance of the proposed dwelling is satisfactory, we OBJECT to the application as it contravenes Policy H16.
e) 20583/031 – Benchmark Resources Ltd – Variation of condition 26 of 20583/030 to allow substitution of plans to seek to align some of the buildings, Headley Park Hotel, Picketts Hill – NO OBJECTION
f) 49600/007 – Mr R Houghton – Detached dwelling following demolition of barn, The Spinney, Beech Hill, Headley Down – NO OBJECTION provided the barn to the rear is demolished before the house is occupied.
P90/19. APPLICATIONS TO LOP/FELL TREES
It was RESOLVED that the following comments on the tree applications received from the Head of Planning and Development Services, EHDC, be passed to EHDC:
